General terms and conditions of sale

The general conditions of sale (hereinafter referred to as "GTCS") apply to all orders placed and contracts concluded (hereinafter referred to as "order") via the online store www.manoe.ch (hereinafter referred to as the "site").

The site is operated by the company Manoé Martin (hereinafter referred to as "the company Manoé") an individual company whose registered office is at Avenue C.-F. Ramuz 83a, CH-1009 Pully, registered in the Commercial Register of the Canton of Vaud under number CHE-332.596.811.

The GTCS define the contractual relationship between the company on behalf of www.manoe.ch on the one hand, and any individual or legal entity visiting or making a purchase on the site for itself or for a third party (hereinafter referred to as "the customer"), on the other hand. In order to lighten the subject, Manoé has systematically opted for the feminine noun. However, the texts published on the site and its products are also intended for men.

All new features and new products that will be added to this store at a later date will also be subject to these Terms and Conditions of Sale. The customer can consult the most recent version of the GTCS at any time on this page. The company reserves the right to change the GTCS. The version of the Terms and Conditions in force at the time of the order shall apply. It cannot be changed unilaterally at the time of ordering. It is the responsibility of the customer to check this page regularly for any changes. Continued use of the website by the customer or access to the website by the customer after publication of any changes constitutes acceptance by the customer of such changes.

The company's website is hosted by Shopify who provides the online platform for the company to sell its products. Customer data is stored in the Shopify data storage system and databases, and in the general Shopify application. These are kept on a secure server.

Terms and Conditions of Use of the Online Store

By accepting these General Terms and Conditions of Sale, the customer declares that she has reached the age of majority in her country or that she has the agreement of her legal representative.

The company reserves the right to refuse access to the products at any time and to any person for any reason whatsoever.

The customer undertakes not to reproduce, copy, sell or resell any of the products of the company, without the express prior written permission of the company.

Products

Some products may be available in limited quantities and may be subject to returns in accordance with the Company's Return Policy.

Specific conditions for the purchase of certain products are defined below.

The company has made every effort to display as clearly as possible the colors and images of its products presented in the shop. However, it cannot guarantee that the display of colors on the customer's computer screen is accurate. The photos appear on the site only as illustrations and are not part of the contractual conditions.

The company reserves the right to limit the quantities of all products offered, to modify or delete a product without notice and at any time. In addition, all product descriptions may be changed at any time and without prior notice, at the company's sole discretion.

Prices and Changes

The prices indicated on the site are expressed in Swiss francs, excluding taxes, as the company is currently not subject to VAT. Shipping costs are not included in the price but will be charged separately. The company reserves the right to modify its prices at any time but the amounts invoiced to the customer are those corresponding to the prices in force at the date of the order and which appear on the order confirmation and the invoice. The company shall not be liable to the customer or any third party for any price changes.

Conclusion of the contract

The contract is concluded as soon as the customer places an order on the site. During the process of validation of each order, the customer must read and accept the GTCS set out in this contract, so that her order can be registered. Any person having made a purchase on the site therefore declares to have read them perfectly and cannot deny this fact in case of dispute.

Receipt of the order is confirmed to the customer by an automatically generated e-mail sent to the address provided by the customer. The e-mail confirming the order does not constitute a guarantee of availability or delivery. It only indicates to the customer that the company has received her order and that the contract is therefore concluded, provided that delivery is possible. The execution of the order only takes place after the customer has paid the full amount of the order.

Payment

Payments are made exclusively on the website www.manoe.ch via Mollie or Twint. The company declines all responsibility in case of malfunction of the payment services. The price invoiced is the one indicated on the order confirmation sent to the customer.

The execution of the order will be carried out after agreement of the bank payment center. In case of agreement of the latter, the account will be immediately debited and the order validated. In case of refusal, the order will be cancelled.

In addition, the company reserves the right to refuse any order from a customer with whom there is a dispute or to cancel any order because of a payment incident.

The data recorded by Manoé constitute proof of communications, orders and payments between the parties. The archiving of purchase orders and invoices is made on a reliable and durable medium that can be produced as evidence.

Mollie

Payments are made online in a secure manner via the electronic payment module set up by the Mollie partner (hereinafter referred to as the "Mollie module") by credit card. The cards accepted are : Visa, Mastercard and American Express. Mollie uses the most recent and reliable security systems, including PCI DSS certification.

The customer making a payment via the Mollie module is considered to have read and fully accepted their General Privacy Policy.

At the time of order validation, the customer expressly acknowledges that the communication of her credit card number to the company Manoé through the Mollie module is equivalent to authorization to debit her account up to the amount of the items ordered. The company Manoé can not be held responsible for changes or errors that may appear in the information published by Mollie.

Twint

The Twint payment function offers the possibility to pay by smartphone through an application. There are no additional costs for the customer. For more information, the customer is invited to consult the General Terms and Conditions for the use of Twint.

Taxes and delivery charges

Currently, the company is not subject to VAT. However, customs duties, fees and taxes that may be levied by the authorities of other countries, in case of delivery outside of Switzerland, are the responsibility of the customer.

The delivery times are as follows:

  • Switzerland: 3 to 5 working days
  • Europe: 5 to 12 working days
  • Rest of the world: 10 to 20 working days

The delivery of Manoé products outside of Switzerland depends on the speed of the post office and the delays inherent to customs clearance.

Returns

Our return policy is valid only for jewellery and within 7 days after receipt of the product.

In case of a return, the customer must first contact Manoé by sending an e-mail to the following address: hello@manoe.ch or via the form here , specifying that she wishes to make a return. To be eligible for a return, the customer must send the item in its condition and in its original packaging with a copy of the invoice. The shipment must be made by registered mail with a tracking number to be sent to us by e-mail. If this is not the case, the right of return is no longer valid.

In order to proceed with the return of the item, the customer must send it by post to the following address: Manoé Martin, Avenue C.-F. Ramuz 83a, 1009 Pully, Switzerland.

The shipping costs related to the return of the article will be borne by the customer.

Once Manoé has received and checked the returned item, an e-mail will be sent to the customer to confirm its receipt and the decision of Manoé as to the validation or refusal of the return of the product.

If the return is accepted, the full amount committed by the customer (excluding shipping costs, taxes) will be refunded. In this case, the corresponding amount will be credited to the customer's account. The company reserves the right to ask the customer for her bank details in order to make the refund.

Exclusion of the right of return

Gift cards cannot be returned or exchanged.

Warranty

The legal warranty is 2 years. The guarantee takes effect on the date of delivery of the product, justified by the invoice sent to the customer by the company via e-mail when placing the order. Are not covered: damages due to improper maintenance, failure to follow washing instructions, or normal wear and tear.

It is the responsibility of the customer to check the goods immediately upon receipt of the delivery and to make any claims for possible defects, non-conformities and transport damage.

Errors, Inaccuracies and Omissions

Some information on the site may contain typographical errors, inaccuracies or omissions that may relate to product descriptions, prices, promotions, offers, product shipping costs, delivery times and availability. The company reserves the right to correct any errors, inaccuracies, omissions, change or update information or cancel orders, if any information on the site or on any other related website proves to be inaccurate, at any time and without notice (including after the customer has sent her order).

The company is under no obligation to update, modify or clarify any information on its site or any other associated website, including but not limited to pricing information, unless required by law. No set date for updating or refreshing on the company's site or any other associated web site should be relied upon to conclude that the information on its site or any other associated web site has been changed or updated.

Applicable law and place of jurisdiction

The relations between Manoé and its customers are exclusively governed by Swiss Law. Any litigation will be treated by the District Court of the EST VAUDOIS in VEVEY, SWITZERLAND.
